You must do the thing you think you cannot do. -- Eleanor Roosevelt LAWMAN ACCUSED BY VICTIM Mar 5 2006 By Marion Scott LORD Advocate Colin Boyd has been forced to admit why he failed to prosecute a teacher in the De La Salle child abuse scandal. Boyd has revealed the 82-year-old former teacher at the List D school was told he would not be charged because there was insufficient evidence. Prosecutors say they only learned of a second allegation against him, backing the claims of cruelty, in September, when the case had become time-barred. But the statement was made in May, before the case ran out of time. Boyd's explanation meant a judicial review of the case in the Court of Session was dropped. But now one of the alleged victims, Emile Szula, 54, is to take the case to the European Court of Human Rights, claiming Boyd was wrong not to prosecute. If he wins, the Crown Office could be ordered to make a six-figure payout. Mr Szula said: "I feel that I, and many other victims, have been badly let down by the Scottish judicial system." Ten alleged paedophiles at the now closed school, which was run by the De La Salle order of monks, in Gartmore, Stirlingshire, were identified in a police inquiry six years ago.
